1. Acceptance of Terms

By accessing or using PowerPicks.ai, you acknowledge and agree to abide by these Terms. If you do not accept these Terms, you must discontinue use immediately. Ongoing use of our platform following any updates to these Terms signifies your acceptance of those changes.

2. Platform Description & Eligibility

PowerPicks provides AI-generated sports predictions, analytics tools, confidence ratings, and market research features for entertainment and educational purposes. We are not a sportsbook, bookmaker, or gambling operator and do not accept, process, or facilitate wagers of any kind.

You must be at least 18 years of age (or the legal age in your jurisdiction) to use PowerPicks. By using our platform, you confirm that you meet this age requirement and that your use does not violate any laws applicable in your location.

We reserve the right to deny or revoke access to any user at any time and for any reason, including if we believe a user is accessing our services from a jurisdiction where sports analytics information services may be restricted.

3. Account Registration & Security

You are responsible for safeguarding your login credentials and for any activity that takes place under your account. You must notify us promptly if you suspect unauthorized access or a security breach.

You agree to supply accurate and up-to-date information when creating your account and to keep that information current. We may suspend or close accounts where we reasonably believe the information provided is false, outdated, or misleading.

4. Account Deletion & Data Removal

You may delete your PowerPicks account and all associated personal information at any time directly from your account dashboard. To do so, log in and visit your Dashboard, then navigate to Account Settings and select "Delete Account." Upon confirmation, your account and all personally identifiable data associated with it will be permanently removed from our active systems, subject to any limited retention required by law (for example, fraud prevention, tax, or regulatory records) as described in our Privacy Policy.

Once deleted, your account cannot be restored, and you will lose access to any active subscriptions, pick history, and saved preferences. If you are unable to access your account to complete this process, you may email support@powerpicks.ai and we will process your deletion request within a reasonable period consistent with applicable law.

5. Subscriptions & Billing

Certain features on PowerPicks require a paid subscription. Subscription fees are charged in advance on a recurring basis (weekly, monthly, or annually depending on the plan selected). You may cancel at any time; however, no partial refunds are issued for unused portions of a billing cycle.

Pricing may change at our discretion. We will make reasonable efforts to communicate material pricing changes in advance. We also reserve the right to modify or discontinue features or services without prior notice.

5.1 Free Trial

New PowerPicks subscribers may be eligible for a seven (7) day free trial of a paid subscription plan. Eligibility, availability, and the specific terms of the free trial are described below and may be modified or withdrawn by PowerPicks at any time without notice.

• Duration. The free trial lasts for seven (7) consecutive days, beginning at the moment you complete sign-up and confirm your subscription selection.
• One trial per user. Only one free trial is permitted per user, per Apple ID, and per Google Play account. Free trials are generally not available to users who have previously held a paid or trial subscription with PowerPicks. We reserve the right to deny a trial to any user we reasonably believe is attempting to obtain more than one trial.
• Payment method required. A valid payment method (or a billing relationship through Apple or Google) is required at sign-up. You will not be charged during the trial period unless you upgrade, change plans, or otherwise authorize an immediate charge.
• Automatic conversion to paid subscription. Unless you cancel before the end of the 7-day trial, your subscription will automatically convert to a paid plan and your payment method will be charged the then-current price for the plan you selected. Subscriptions renew automatically at the end of each billing period until cancelled.
• Pricing after the trial. When purchased through PowerPicks.ai (Stripe), prices are currently $33 per week, $99 per month, or $799 per year. When purchased through the Apple App Store or Google Play, prices are currently $34.99 per week, $99.99 per month, or $799.99 per year. Applicable taxes may apply. Prices may change; any changes will be communicated in advance as required by law.
• How to cancel.
  • Web (Stripe): Sign in and visit your Billing page or use the “Manage Subscription” link to open the Stripe customer portal.
  • iOS (Apple): Open Settings → tap your name → Subscriptions → PowerPicks → Cancel Subscription.
  • Android (Google Play): Open the Google Play Store → tap your profile icon → Payments & subscriptions → Subscriptions → PowerPicks → Cancel subscription.
• Cancellation timing. To avoid being charged, you must cancel at least 24 hours before your free trial ends. If you cancel during the trial, you will retain access to paid features until the trial period ends, after which your account will revert to a non-paying state.
• No refunds for partial periods. If you forget to cancel and are charged at the end of the trial, no refunds or credits are issued for partial subscription periods, except where required by applicable law. Apple App Store and Google Play purchases are governed by Apple’s and Google’s respective refund policies.
• Loss of trial eligibility. If you cancel during a trial and later resubscribe, the new subscription will begin as a paid subscription without an additional free trial unless we expressly offer one to you.

By starting a free trial, you acknowledge that you have read and agree to these terms, including the automatic conversion to a paid subscription at the end of the trial period.

6. Disclaimers & Limitation of Liability

All content provided by PowerPicks — including picks, confidence scores, Positive EV results, Trap Detector alerts, and Line Movement data — is strictly for informational and entertainment use. Specifically:

• Our content does not constitute betting advice or financial recommendations
• Historical accuracy and past results are not indicative of future performance
• Predictions may contain errors or inaccuracies despite our best efforts
• Our tools should not be your sole basis for making any wagering decisions
• All sports outcomes involve inherent uncertainty and risk

TO THE FULLEST EXTENT ALLOWED BY LAW, POWERPICKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF OUR SERVICES. IN NO EVENT SHALL POWERPICKS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

Certain jurisdictions do not permit the exclusion of specific warranties or limitations on liability. In such cases, the above limitations apply only to the extent permitted by applicable law.

7. Intellectual Property

All content, features, functionality, text, graphics, logos, software, and data compilations available through PowerPicks are the exclusive property of PowerPicks Holdings LLC or its licensors and are protected under copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any materials from our platform without express written consent.

8. User Conduct

You agree not to misuse the PowerPicks platform, including but not limited to: attempting to reverse-engineer our algorithms, scraping or harvesting data, impersonating another user, or using the service for any unlawful purpose.

9. Modifications to Terms

We may revise these Terms at any time. Material changes will be communicated through our website or via email. Your continued use of PowerPicks after such changes constitutes your acceptance of the revised Terms.

10. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, except that either party may pursue claims in small claims court.
